Our services include Business Health Scores, customer sentiment analysis, competitor benchmarking, advertisement creation tools, and campaign management.

The insights and recommendations provided by our platform are generated by AI and are intended to be informational in nature. They should not be considered as professional financial, legal, or business advice.

To access our services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms or are used for unauthorized purposes.

You agree not to use the platform to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other user accounts
• Scrape, crawl, or use automated means to access the platform without our written consent

All content, features, and functionality of the Trowel.ai platform, including but not limited to text, graphics, logos, icons, software, and AI models, are the exclusive property of Trowel.ai and are protected by intellectual property laws.

You retain ownership of any data you provide to the platform. By using our services, you grant us a limited license to process your data solely for the purpose of providing our services to you.

Your use of the platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using Trowel.ai, you consent to the data practices described in our Privacy Policy.

Certain features of the platform require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. All fees are non-refundable except as required by law.

We reserve the right to change our pricing at any time. If we change the pricing for your current plan, we will provide at least 30 days' notice before the new pricing takes effect. You may cancel your subscription before the new pricing period begins if you do not agree to the changes.

We do not guarantee that the AI-generated insights and recommendations will be accurate, complete, or suitable for your specific business needs. You acknowledge that business decisions made based on our insights are at your own risk.

To the maximum extent permitted by law, Trowel.ai and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the platform.

Our total liability for any claims arising from or related to these terms or the platform shall not exceed the amount you paid us in the twelve months preceding the claim.

You agree to indemnify, defend, and hold harmless Trowel.ai and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your use of the platform, your violation of these terms, or your violation of any rights of another party.

We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason, including if you breach these terms. Upon termination, your right to use the platform will cease immediately.

You may terminate your account at any time by contacting our support team or through your account settings. Upon termination, we will handle your data in accordance with our Privacy Policy and applicable data retention requirements.

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these terms will otherwise remain in full force and effect.
